TERMS | COPYRIGHT | LEGAL | LIABILITY | USAGE OF PHOTOS, VIDEO HIGHLIGHTS, AERIAL PHOTOS AND VIDEOS FOR PERSONAL AND OR BUSINESS ADVERTISING, VISUAL MARKETING AND WEBSITE DESIGN. Your Photography by Kimberly Kalan LLC Visual Design and Marketing will release all photo(s), and video highlight(s) and grants you the client(s) LIMITED rights to use, download and print digital and aerial photo(s), and video highlight(s) once your balance is paid in full.   Altering, editing, or changing images in any way is restricted without written permission. All balances are due upon receipt before your gallery is released to you. Your Photography by Kimberly Kalan LLC Visual Design & Marketing will retain full copyright rights of all digital, aerial photos, video and video highlight(s) and retains the right to use any at any time all digital, aerial photo(s), video(s) and video highlight(s) for portfolio, marketing, website, social media on all platforms  and for business promotion. Any requested variation will be made in writing and agreed in a personalized usage contract signed by both parties. If you are interested in FULL EXCLUSIVE RIGHTS please contract me prior to your project completion to discuss fees and terms of your requested Exclusive rights which will only be granted by a signed written contract by both parties. If photo(s) or video(s) are donated credit is required to be given to photographer on all platforms and Full rights and ownership belong to the Photographer exclusively. The Client, Business or Individual does not have permission or rights to share, alter, use or to receive paid services from other clients or to generate income from donated work unless stated in a written signed contract agreed to by both parties with the terms set forth. It is the your responsibility to download and store your paid for project files.  Client galleries will be available for up to 3 months unless other arrangements are made or contracted ongoing work is provided. By using this website & my services you agree to these terms and agree to fully release Your Photography by Kimberly Kalan LLC Visual Design & Marketing and Kimberly Kalan from any and all usage, damages, injuries, losses, property damage, land damage, claims, liabilities, equipment malfunction, failure, and or loss of digital files due to weather circumstance or any other situation or circumstance not mentioned here for any and all Photography, Videography, Film,  Aerial and Video services provided for personal and business use at any time present or future.  Terms are subject to change.

Confidentiality, Privacy Policy and Notice: The online Client gallery contains Photos, Images and or Videos intended exclusively only for the authorized Client who purchased the service. If you are not the intended recipient, any review, disclosure, download, copying, distribution, or use of the contents is strictly prohibited.
